Conclusion of the agreement

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. Orders are placed online. When the customer adds products to their shopping cart and confirms their selection by clicking the button labelled “PLACE ORDER”, a binding order is placed. A contract is only concluded when Gottlieber Spezialitäten AG sends an order confirmation to the customer by e-mail.

Liability

Gottlieber Spezialitäten AG assumes no liability for:

  • Inability to deliver or late delivery of products due to an incorrectly stated or erroneous delivery address or absence of the recipient
  • The performance of third-party service providers, for example, late delivery by external shippers, postal services etc.
  • Delayed print approvals
  • Unforeseeable problems with customs processing, customs issues or events due to force majeure
  • Inclusion of valuables by the customer, such as cash, coupons, motorway charge stickers, etc.

 

Shipment within Switzerland and to Liechtenstein

Shipping costs

The shipping costs include postage, packaging, handling & insurance costs. They are individually calculated and displayed before placing the order.

We ship all packages in Switzerland and Liechtenstein using Planzer. PickPost addresses can not be delivered. Please note that your package will be deposited in your mailbox as the standard delivery option (provided there is space). No shipping costs are charged for priority shipping on orders with goods valued at CHF 70.00 and up per delivery address.

Flat rate for large shipments

For large orders shipped on pallets, we charge a flat rate of CHF 70.00 per pallet.

Delivery time

Most items are available directly from stock. For shipments within Switzerland and Liechtenstein, the delivery term for priority shipping is 2 – 4 working days. We do not take responsibility for delayed deliveries caused by third-party logistics service providers.

The delivery time may be longer for orders of certain items in large quantities.

No summer post on certain Fridays: We do not send out mail on Fridays when temperatures are high. This is intended to prevent products from being exposed to high temperatures for long periods due to storage over the weekend. These orders are sent on Monday.

Individual Dispatch Orders

Please note that for individual dispatch orders with several addresses and a product value of less than CHF 70 per delivery address, we charge a flat rate for individual dispatch per product plus postage costs. We send you the exact cost breakdown for the flat-rate fee with the quote.

In the case of goods of the value of CHF 70 or more per delivery address, we charge an administration fee of CHF 5 per product for individual dispatch.

 

Shipment within the European Union

You can order a selection of our Gottlieber specialities on amazon.de/Gottlieber-Spezialitaeten for shipment within the EU. If international shipping is available, you will find the corresponding link to amazon.de/Gottlieber-Spezialitaeten with the corresponding product in our online shop at gottlieber.ch. Purchase made through amazon.de are subject to their general business terms and conditions. The purchase contract is concluded with Gottlieber Spezialitäten AG. Orders placed through amazon.de are processed by Swisslogistik.

Shipping costs within the EU

The shipping costs include postage, packaging, handling, and insurance costs. Shipping costs and the like are detailed in the ordering process on amazon.de and are displayed before the order is placed.

Delivery term within the EU

Shipping within the EU is via GLS (1–2 working days in Germany, 2–6 working days outside Germany). After your order is received, you will get an order confirmation by email with a tracking code which will let you see the current status of your order.

Shipment outside the EU

We currently do not offer international shipment outside the EU.

International shipment for business customers

In certain cases, we offer business customers the option of international shipment from Gottlieber Spezialitäten AG in Switzerland. The charges for handling, customs clearance of the products, etc. are invoiced to business customers as quoted.

Our logistics partner based in Konstanz, Germany processes international shipments. For the purpose of processing and filling the order, we provide our logistics partner with the personal data provided by you, including the address data of the recipient. The personal data of all parties involved in processing are erased after the order is processed.

Personalized Items

Personalized items such as cartoon sleeves, delicacy boxes, banderole, etc. are individually made for you. Please contact us directly to discuss your customization request: firmenkunden@gottlieber.ch or phone +41 71 666 60 70. We make (almost) anything possible.

Tools such as cylinders, cutting dies, etc. that are needed for the production of personalized items will be destroyed by us after 3 years of no reorders.

Packaging and design changes

In order to keep up with the times, we regularly update/revise the design of our products. Therefore, we reserve the right that there may be changes, color deviations, etc. in the product design or product packaging.

Retention of title

Goods remain the property of Gottlieber Spezialitäten AG until they are paid for in full.

Damages

No claims for damages can be asserted based on possible errors in the illustrations, prices or texts. The same applies to late deliveries.

Payment

If you choose to register and successfully pass a credit check, you have the option to pay by invoice (payable within 20 days) or by Twint, credit card or PostFinance e-finance.

Guest orders without registration can only be paid by Twint, credit card or PostFinance e-finance.

We reserve the right to perform a credit check and to only deliver subject to advance payment on a case-by-case basis. For orders of third-party products valued at CHF 150.– and up (e.g. alcohol), we reserve the right to only ship the goods subject to advance payment. For orders of CHF 10,000 and up, 30% of the total is billed to you in advance (payable within 10 days) and the remainder falls due upon receipt of the goods, payable within 20 days.

Prices and Value-Added Tax (VAT)

Our pricing is in accordance with our recommended retail prices for resellers and retailers. Individual resellers may offer lower prices or promotions on standard items than we are able to offer in our online shop at gottlieber.ch, in our Sweets & Coffees shops, in our other retail outlets or for business customers. We are unable to control or prohibit this. Therefore, advice from Gottlieber Direct Sales is free and shipping within Switzerland and Liechtenstein is free of charge for orders of CHF 70.– and over. We also offer the quantity and scaled discounts listed below to private and business customers.

All items are offered in Swiss francs (CHF), including the VAT listed on the final invoice. The prices in our online shop are accurate on the day. They may deviate slightly from our catalogue prices. Printing errors and mistakes excepted (E&OE).

Quantity and scaled discounts

We offer a quantity discount on orders of 50 or more units of the same product. The scale is as follows:

   5%
250–499 pieces  8%
500–699 pieces  12%
700–999 pieces  15%
from 1000 pieces  16%

The quantity discount cannot be combined with any other discounts.

Vouchers

The following provisions apply for all Gottlieber vouchers.

  1. Vouchers are only valid for the time period specified when they are issued. The validity period cannot be extended.
  2. Vouchers can only be redeemed before placing the order. They cannot be deducted after the order is placed. Gottlieber reserves the right to only accept one voucher per order.
  3. Vouchers may not be applied to product’s shipping charges.
  4. If the price of your order exceeds the value of a voucher, you may pay the difference using the various payment methods offered.
  5. Vouchers are not paid out in cash and do not earn any interest.
  6. Lost and, in particular, stolen vouchers will not be refunded. Gottlieber assumes no liability for lost vouchers.
  7. Gottlieber reserves the right to require alternative methods of payment, refuse delivery and/or block customer accounts in case of reasonable suspicion of abuse related to the use of vouchers.
  8. Vouchers and discount codes cannot be used for international shipping via amazon.de and are only redeemable through gottlieber.ch.

The following additional provisions apply for all vouchers except purchased (gift) vouchers:

  1. Vouchers are non-transferable.
  2. A minimum order value may be required for vouchers. For administrative reasons, remaining balances which occur when the value of a purchase is below the voucher value cannot be refunded or credited.
  3. Vouchers will not be refunded.

Products containing alcohol

The sale of products containing alcohol (wine, spirits, sparkling wine, etc.) to persons under 18 years of age is prohibited in Switzerland and Europe. If your order includes products which may only be sold subject to an age restriction, a corresponding pop-up notification is displayed during the ordering process. By placing the order and acknowledging the pop-up notification in the online shop of Gottlieber Spezialitäten AG, the customer accept these provisions and confirms that they he/she is authorised to make the purchase.

Taking back/exchanging

Products delivered to the client undamaged and in a state of completeness will not be taken back or exchanged.

Data protection

The data necessary for the handling of the transaction will be stored and forwarded to the company contracted with the delivery in the context of the handling of your order. Otherwise, the data will not be forwarded to third parties other than for creditworthiness checks and, if necessary, for collections procedures. The data will be used for the purpose of client care within Gottlieber Spezialitäten AG both domestically and abroad. 

The separately described additional information relating to data protection forms an integral part of these GT&C.

The contents of the website may not be circulated, published, modified, put to further use, passed on or be used for public or commercial purposes. Gottlieber Spezialitäten AG cannot guarantee or accept responsibility for the correctness or completeness of its homepage and declines all liability for incomplete or erroneous contents.

Place of jurisdiction

The customer recognises Gottlieben as place of jurisdiction.
